土地领域存在的矛盾和问题已经成为影响中国社会和政治稳定的主要问题之一。土地问题产生的根源是土地权利与义务的双重缺失与失衡。这种缺失和失衡,使得国家、集体和个人的利益都缺乏制度化的实现和调节机制,导致土地利用上的囚徒困境博弈和公地悲剧。因此,要制度化地解决中国土地领域存在的问题,必须构建权利与义务平衡的土地管理制度体系,形成各方合理的利益结构,而这也构成了中国土地管理制度改革的一个主要目标。同时,制度化的土地管理模式,也需要进行财税体制改革,改变中国土地管理的制度环境。  相似文献

Few Indian reservations have any semblance of a private sector. Consequently, poverty and unemployment are major problems in much of Indian country. While there are many reasons why private enterprise is scarce in Indian country, one of the foremost reasons is businesses do not trust tribal courts. Businesses' distrust of tribal courts is not unique as outsiders often fear bias in foreign tribunals. Similarly, businesses are often concerned about a court's capacity to adjudicate complex disputes. Federal diversity jurisdiction was developed to allay fear of bias, and many states have developed business courts to address questions about court capacity. Tribes can overcome these issues by creating an intertribal business court (IBC). Tribes will be free to sculpt the IBC as they see fit. However, the IBC's intertribal nature will help reduce fears of bias, and an IBC's focus on business disputes will answer doubts about court capacity. An IBC will also make tribal law more accessible, further increasing confidence in this new tribunal. As businesses gain greater confidence in tribal legal institutions through the IBC, they will be more likely to operate in Indian country. Accordingly, the IBC could help to transform tribal economies.  相似文献

Although Uber's arrival in China has resulted in disruptive competition for incumbent taxi companies, it offers an attractive alternative in China's supply-demand-imbalanced urban passenger transport system. China's regulatory regime for Uber has evolved in three stages: from the regulatory vacuum prior to 2015 to its official legalization in 2015–2016, and the enactment of numerous local regulations in 2016, with specific and more demanding requirements for Uber. This policy is a part of the Chinese approach to the gradual liberalization of the urban passenger transport market. Policymakers should consider ‘fair competition’ as the guiding principle to balance the interests of sharing firms and incumbent service providers, as well as between different sharing firms. The core value of this principle lies in the benefits it provides for consumers and the way it engenders a pro-competitive market environment. The labor protection arrangements for sharing firms’ laborers should be more flexible and diversified. In order to recognize whether an Uber-Driver is an employee or independent contractor, a new standard taking into account a range of factors should be established through collective negotiations between the participants of the sharing economy, and dialogues between members of the judiciary, academics, and the policymakers. Further, consumer protection law and personal data protection provisions should apply when sharing firms misuse their distinctive algorithmic management model to compete unfairly to the detriment of consumers and other users. Ex ante regulatory measures designed to protect the personal data of users should be introduced for deployment in the context of the sharing economy. When enforcing these rules, a balance should be struck ensuring free data flow that is essential to sharing firms’ innovation and competition, and the need to ensure the level of data security required to underpin a well-functioning sharing society.  相似文献

Nowadays, the complexity of financial products makes it difficult for retail clients to identify investment risks, and there is an increasing tendency for firms, stipulated by the maximum profits, to recommend or enter into unsuitable transactions to or for retail clients while providing services of investment advice and portfolio management, which causes great losses to a significant number of investors. So, in the contemporary society, the investor suitability rules through which retail clients can purchase suitable financial products are the indispensable legal basis of investor protection. Currently, the regulations concerning investor suitability management in China have several problems, including the chaotic legal system, low effectiveness level and defective contents, which may make it difficult for suitability to be applied in justice and managed effectively. Since the UK’s investor suitability rules in the Conduct of Business Sourcebook that apply to retail clients whose contents include requirements of obtaining retail clients’ information, requirements of information to be provided to retail clients and criteria of assessing suitability are clear and comprehensive, the authors believe that the UK’s experiences can provide a great enlightenment for China to better investor suitability management rules, including integrating legal documents and optimizing effectiveness level, rationalizing application scope, adding criteria of assessing suitability and revising specific clauses.  相似文献

Abstract

This study investigates hypotheses regarding the association of census tract variables with the risk for homelessness. We used prior address information reported by families entering emergency shelters in two large U.S. cities to characterize the nature ofthat distribution.

Three dense clusters of homeless origins were found in Philadelphia and three in New York City, accounting for 67 percent and 61 percent of shelter admissions and revealing that homeless families’ prior addresses are more highly concentrated than the poverty distribution in both cities. The rate of shelter admission is strongly and positively related to the concentration of poor, African‐American, and female‐headed households with young children in a neighborhood. It is also correlated with fewer youth, elderly, and immigrants. Such areas have higher rates of unemployment and labor force nonpartici‐pation, more housing crowding, more abandonment, higher rates of vacancy, and higher rent‐to‐income ratios than other areas.  相似文献

Abstract

This article summarizes a special issue of Housing Policy Debate, which commemorates the 50th anniversary of the Housing Act of 1949. The act is best remembered for its declaration that every American deserves a “decent home and a suitable living environment.” The articles in this collection offer varying perspectives on how this act helped shape the postwar metropolis. The authors—urban planners, historians, and public officials—each consider a different part of the legacy.

The first three articles deal primarily with the act's creation and social and political ramifications, while the next three look at how Titles I, II, and III have influenced the past 50 years of housing and urban policy. The record of the Housing Act of 1949 is mixed, and so are its lessons. There remains an ongoing struggle to find the right mix of housing support to reach the goals first expressed in this landmark legislation.  相似文献

Some commentators have observed that today's Cabinet ministers are younger and less experienced than their predecessors. To test this claim, we analyse the data for Labour and Conservative appointments to Cabinet since 1945. Although we find some evidence of a decline in average age and prior experience, it is less pronounced than for the party leaders. We then examine the data for junior ministerial appointments, which reveals that there is no trend towards youth and inexperience present lower down the hierarchy. Taking these findings together, we propose that public profile is correlated with ‘noviceness’; that is, the more prominent the role, the younger and less experienced its incumbent is likely to be. If this is correct, then the claim that we are witnessing the rise of the novice Cabinet minister is more a consequence of the personalisation of politics than evidence of an emerging ‘cult of youth’.  相似文献

The real test of the British Labour Party's new orientation to Europe will be its policy on economic and monetary union (EMU). This article analyses Labours political economy in relation to European integration and to the management of the currency, and how the intersection of these two have produced four distinctive approaches to EMU within the party. 构建社会主义和谐社会,对政策制定的科学化和民主化提出了新的更高的要求,即必须更加重视各方利益的表达和协调,以实现共赢。本文在综合分析软科学和政策科学两个相对独立的学科现状的基础上,讨论当前政策研究在利益分析上存在的不足及其根源,指出政策研究需要超越先前主流的实证主义范式,发展面向利益分析的理论和方法。针对我国政策制定中利益分析和协调的现实需求,本文介绍了一种基于讨论式博弈和综合集成支持的公共政策实验方法(EPRM),论述了该方法的基本思路、运用过程和若干焦点问题。  相似文献

冷战结束以来,中国和西方对“安全环境”的界定不同,中国侧重于以发展界定安全,西方大国则注重以威胁界定安全。中国政府和学术界对“安全环境”的理解,已经从以军事安全为主演变为军事、政治、经济、舆论四位一体,更具复杂性和动态性特征。因此,作者构建了新时期评估周边安全环境的分析框架与指标体系,包括政治安全环境、军事安全环境、发展安全环境、舆论安全环境以及中国自身对周边环境的塑造能力等构件,这些指标囊括了现实主义、自由制度主义和建构主义的学理判断。文章利用世界银行数据库、清华大学当代国际关系研究院的“中外关系数据库”以及《人民日报》数据库对各细分指标进行无量纲化处理,设定并对比了三种场景下的中国周边安全环境指数。对1992-2011年周边安全环境的分析表明,中国周边安全环境处于不断改善中。不过,2008年以后三种场景产生较大分叉,中国有可能已经进入了一个与前十几年完全不同的状况,中国需要与周边国家共同构建长期稳定的周边安全合作环境。  相似文献
